Peer-reviewed studies report significant REE content in karst bauxites from the Sierra de Bahoruco, with total concentrations between 0.07% and 1.40% by weight, and yttrium between 0.01% and 1.48%, depending on the deposit and mineralogy.<\/span><\/p>\n<p><span dir=\"auto\" style=\"vertical-align: inherit;\">They are not equivalent to reserves, but they do justify exploration campaigns and metallurgical testing aimed at recovering neodymium, praseodymium, lanthanum, and other elements critical to the energy transition.<\/span><\/p>\n<h1 data-start=\"166\" data-end=\"220\"><img Through <\/span><strong><span dir=\"auto\" style=\"vertical-align: inherit;\">Decree 430-18<\/span><\/strong><span dir=\"auto\" style=\"vertical-align: inherit;\"> , the Executive Branch declared the <\/span><strong><em><span dir=\"auto\" style=\"vertical-align: inherit;\">\u00c1vila fiscal mining reserve<\/span><\/em><\/strong><span dir=\"auto\" style=\"vertical-align: inherit;\"> in Pedernales for the exploration and evaluation of rare earths through direct state management or through special contracts, based on Article 17 of the Mining Law.<\/span><\/p>\n<p><span dir=\"auto\" style=\"vertical-align: inherit;\">In <\/span><strong><span dir=\"auto\" style=\"vertical-align: inherit;\">2024 , the <\/span><\/strong><strong><span dir=\"auto\" style=\"vertical-align: inherit;\">Dominican Mining Company (Emidom)<\/span><\/strong><span dir=\"auto\" style=\"vertical-align: inherit;\"> was created , with a mandate to conduct feasibility studies, partner with, and conduct strategic mineral projects.<\/span><\/p>\n<p><span dir=\"auto\" style=\"vertical-align: inherit;\">The public discourse set a validation horizon. <\/span><em><span dir=\"auto\" style=\"vertical-align: inherit;\">In February 2025, a preliminary estimate of \"around 100 million tons<\/span><\/em><span dir=\"auto\" style=\"vertical-align: inherit;\"> \" of rare earths was reported, subject to technical confirmation.<\/span><\/p>\n<p><span dir=\"auto\" style=\"vertical-align: inherit;\">The <\/span><a href=\"https:\/\/mem.gob.do\/\"><strong><span dir=\"auto\" style=\"vertical-align: inherit;\">Ministry of Energy and Mines (MEM)<\/span><\/strong><\/a><span dir=\"auto\" style=\"vertical-align: inherit;\"> has indicated that the formal determination of resources and reserves will require additional campaigns and geological modeling, with the goal of having results by <\/span><strong><span dir=\"auto\" style=\"vertical-align: inherit;\">2026<\/span><\/strong><span dir=\"auto\" style=\"vertical-align: inherit;\"> ; in that phase, the <\/span><strong><span dir=\"auto\" style=\"vertical-align: inherit;\">U.S. Army Corps of Engineers (ERDC)<\/span><\/strong><span dir=\"auto\" style=\"vertical-align: inherit;\"> provided scientific assistance.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h1><span class=\"ez-toc-section\" id=\"Legal_framework_and_permits\"><\/span><span dir=\"auto\" style=\"vertical-align: inherit;\">Legal framework and permits<\/span><span class=\"ez-toc-section-end\"><\/span><\/h1>\n<p><span dir=\"auto\" style=\"vertical-align: inherit;\">Law <\/span><strong><a title=\"Law 146-71 Mining Law of the Dominican Republic\" href=\"https:\/\/ph-f4eshjh7d2d8fvhv.centralus-01.azurewebsites.net\/es\/post\/ley-146-71-ley-minera-de-la-republica-dominicana\/\"><span dir=\"auto\" style=\"vertical-align: inherit;\">146-71<\/span><\/a><span dir=\"auto\" style=\"vertical-align: inherit;\"> (Mining Law)<\/span><\/strong><span dir=\"auto\" style=\"vertical-align: inherit;\"> recognizes state ownership of mineral substances: the right to explore or exploit is acquired through <\/span><strong><span dir=\"auto\" style=\"vertical-align: inherit;\">concessions or contracts<\/span><\/strong><span dir=\"auto\" style=\"vertical-align: inherit;\"> with the State; the law defines stages, deadlines, disqualifications, and sanctions, and empowers the Executive to <\/span><strong><span dir=\"auto\" style=\"vertical-align: inherit;\">reserve areas<\/span><\/strong><span dir=\"auto\" style=\"vertical-align: inherit;\"> for public interest.<\/span><\/p>\n<p><span dir=\"auto\" style=\"vertical-align: inherit;\">The regime is complemented by Environmental <\/span><a title=\"Law 64-00 creating the Secretary of State for the Environment and Natural Resources\" href=\"https:\/\/ph-f4eshjh7d2d8fvhv.centralus-01.azurewebsites.net\/es\/post\/ley-64-00-que-crea-la-secretaria-de-estado-de-medio-ambiente-y-recursos-naturales\/\"><strong><span dir=\"auto\" style=\"vertical-align: inherit;\">Law 64-00<\/span><\/strong> <\/a><strong><span dir=\"auto\" style=\"vertical-align: inherit;\"> , which requires prior authorization, impact assessment , and <\/span><\/strong><strong><span dir=\"auto\" style=\"vertical-align: inherit;\">participation<\/span><\/strong><span dir=\"auto\" style=\"vertical-align: inherit;\"> mechanisms (information, hearings, and consultations) for high-impact projects. The Dominican Republic also <\/span><strong><span dir=\"auto\" style=\"vertical-align: inherit;\">implements the Extractive Industries Transparency Initiative (EITI),<\/span><\/strong><span dir=\"auto\" style=\"vertical-align: inherit;\"> which strengthens transparency and predictability.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h1><span class=\"ez-toc-section\" id=\"Towards_a_concept_of_%E2%80%9Cstrategic_minerals%E2%80%9D\"><\/span><span dir=\"auto\" style=\"vertical-align: inherit;\">Towards a concept of \u201cstrategic minerals\u201d<\/span><span class=\"ez-toc-section-end\"><\/span><\/h1>\n<p><span dir=\"auto\" style=\"vertical-align: inherit;\">In 2022, a regulatory proposal was discussed that introduces the <\/span><strong><span dir=\"auto\" style=\"vertical-align: inherit;\">category of strategic minerals<\/span><\/strong><span dir=\"auto\" style=\"vertical-align: inherit;\"> declared by decree (with rare earths as an example) and reorganizes licenses, concessions, and <\/span><strong><span dir=\"auto\" style=\"vertical-align: inherit;\">special contracts<\/span><\/strong><span dir=\"auto\" style=\"vertical-align: inherit;\"> under greater regulatory powers of the MEM.<\/span><\/p>\n<p><span dir=\"auto\" style=\"vertical-align: inherit;\">Although full adoption is pending, the signal points to prioritizing critical substances with flexible contractual arrangements and reinforced oversight.<\/span><\/p>\n<p><strong><span dir=\"auto\" style=\"vertical-align: inherit;\">Geopolitical and market window.<\/span><\/strong><span dir=\"auto\" style=\"vertical-align: inherit;\"> The global search for <\/span><strong><span dir=\"auto\" style=\"vertical-align: inherit;\">alternative suppliers<\/span><\/strong><span dir=\"auto\" style=\"vertical-align: inherit;\"> to Asia (due to supply chain resilience, <\/span><strong><span dir=\"auto\" style=\"vertical-align: inherit;\">traceability<\/span><\/strong><span dir=\"auto\" style=\"vertical-align: inherit;\"> , and national security) opens up an opportunity for the Dominican Republic.<\/span><\/p>\n<p><span <\/span><\/strong><strong><span dir=\"auto\" style=\"vertical-align: inherit;\">offtake<\/span><\/strong><span dir=\"auto\" style=\"vertical-align: inherit;\"> agreements and financing if studies
